Terms of use

This Site is owned and operated by I.G.D.S. - Jozef Dvorský, with seat at Š. Moysesa 440/48, 965 01 Žiar nad Hronom, Slovakia, Identification Number (IČO) 43 530 974, registered in the Trade Licencing Office Žiar nad Hronom, Number of Licence 680-11712 (hereinafter refered to as „Creatingo”).

Applicability of Terms of use

Access to all Site Files and functions is given to the User on the condition that he/she accepts and agrees with the Terms of Use of the Site, which also includes Privacy Policy section. Use of the Site indicates the User’s consent with these Terms of use. If the User does not agree with the current Terms of Use, he/she should leave the Site.

Creatingo retains the right to revise and change the Terms of Use at any time without notification of the User. The User agrees that to gain full and updated information on the Terms of Use he/she should periodically review this section. The User’s ongoing use of the Site after publication of any possible changes to the current Terms indicates the User’s consent with the effective changes.

Definitions

File
Any kind of illustration, picture materials, photographs, video and audio files or other author´s works presented in electronic form and related information and titles and other materials and information or associated files which are presented at the Site or form the contents of the Site.

Free files
Files accessible to any User regardless of Membership, User is entitled to download these files free of charge.

Premium files
Files accessible only to Premium Members, such Member is entitled to download these Files following the conditions for Premium member.

Member
Every User who has registered by filling in the registration form and created his/her Member's account.

Premium Member
Every User who has registered by filling in the registration form and created his/her Premium Member's account by allocation of the annual Premium membership fee.

Registration
In order to register a registration form must be filled in and sent. By submiting of the registration form User agrees with these Terms of use. The registration form must be filled in and sent only by a person over 18 years of age who is legally competent or a person under 18 years of age in the presence of his/her legal representative who shall also accept these Terms of Use on his/her behalf.
During registration the User shall state his correct and full personal data. It shall not be possible to complete the registration and Use the use the File  without providing the required personal data. The Member may add, amend or adjust the provided data at any time. The Member is aware that some of the provided data are classed as personal data in accordance with Act No. 428/2002 Coll. on Privacy Policy.

Site
The public web pages under the domain “creatingo.com” and any other domains operated by Creatingo.

Use
The File may be used for Members own purposes or for his/her client (on a website, in a printed format, in a electronic document, etc.) and File may be incorporated in a larger work intended for resale by the Member or the Client provided that: a) only the complete work is being distributed, b) the File cannot be extracted as a stand – alone item from a larger work to be reused.

User
Any visitor viewing the Site including Members.

Member's account
By completing registration the User sets up a Member’s account.

Authorization Token
Authorization token is a 13 digit code, unique for each Member. It is used for verification of the Member during the installation of Creatingo Cloud connector extesion for Contao CMS. Authorization token is not transferrable to any third person/party for free and is not a subject of any re-sale or sale. The use of Authorisation Token by Member who is owner of web sites requiring the use of Authorisation Token is not limited.

Intellectual property

All Site assets, including the Files and these Terms of use, the system of organization and presentation of the Files at the Site, are the property of Creatingo and are protected by legal and subordinate acts relating to intellectual property including but not limited to copyright laws and other similar laws.

The User is aware that he/she is not authorized to use the Creatingo business name, its trademarks, logos, domain names or any other marks and business futures of Creatingo.

The licence

Subject to the limitations and restrictions set forth herein, a license gives the Member
1. non-exclusive (other Member may use the same File),
2. transferable (Member may transfer the File to the third person)
3. time-unlimited right to Use a File

The licence does not give the Member right: a) to share the File for free, b) include the file into stock compilation or stock web page of any kind, c) to promise as such or to allow such to happen.

Confidentiality

Creatingo respects the confidentiality of private and personal information of all cooperating parties. For more information about the procedure of collection, use and disclosure of the User’s confidential information, refer to the Privacy Policy section. The User is advised to become familiar with this document.

Site updates

Creatingo regularly updates technical, content and other information on the Site. Nevertheless, Creatingo makes no claim guaranteeing the completeness, accuracy and compliance of the information given at the Site. Creatingo is able to add, review or delete information, resources and services posted on the Site. Also, Creatingo reserves the right to make changes to the Site without prior notification.

Creatingo has the ability and right to suspend, terminate or change any part of the Site or the Site in the whole, its functions, resources or databases without prior notification or additional liabilities.

Applicable law

These Terms of use as well as all legal relation arising on behalf of using the Site shall be governed by law of the Slovak republic. The User also agrees that any disputes arising as a result of using the Site contrary to these Terms of use will be voluntarily settled through negotiations and, in case of failure to come to an agreement, by civil legal proceedings in front of general courts of Slovak republic.

If Creatingo is obligated to go court for collection of any payable fees or enforcement of its rights, the User agrees to reimburse Creatingo for all expenses, payments and fees in the event that Creatingo is successful.

Damages

The User confirms and warrants that he/she has reached the age sufficient to have the rights necessary for usage of the Site and is bound by legal obligations sufficient for any liability that can appear as a result of usage of the Site Files. The User agrees to bear full responsibility for all cases of the Site usage without distinction, as well as for use of his/her login and password by third parties including minors living with him/her.

In case of unauthorized use of the File (breach of the Licence, failure to present a Authorization Token), the Member who purchased the File and allowed such unauthorized use, albeit unintentionally is besides the occurred Damages obliged to pay to Creatingo a contractual penalty in the amount of 300,- €.
